Welcome to SvetArts! The terms “we”, “us” and “our” refer to SvetArts. SvetArts operates this store and website, including all related information, content, features, tools, products and services (the “Services”). SvetArts is powered by Shopify, which enables us to provide the Services.

These Terms of Service (“Terms”) describe your rights and responsibilities when you use our Services. Please read them carefully. By accessing or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our Services.

1. Access and Account

  • You represent that you are of legal age in your jurisdiction and may use the Services.

  • When creating an account or placing an order, you must provide accurate and complete information.

  • You are responsible for keeping your account credentials secure and for all account activity.

  • Accounts are personal and may not be sold, transferred, or assigned.

2. Products and Custom Projects

  • Custom & Unique Products: Many of our products are hand-painted, handcrafted, or custom-made. Custom projects cannot be returned or exchanged, except in cases where the product is defective. Similarly, products delivered as “weird” due to natural handmade variation cannot be returned or exchanged.

  • Product images are for reference; actual appearance may vary due to screen, lighting, and handcrafting differences.

  • We reserve the right to discontinue products, limit quantities, or modify product offerings at any time.

3. Orders

  • Placing an order constitutes an offer to purchase. We confirm acceptance of your order via email.

  • Payment must be processed before order confirmation.

  • Cancellation requests will only be accepted prior to order acceptance.

  • Products are for personal use; commercial resale or export is prohibited without consent.

4. Prices and Billing

  • Prices, promotions, and discounts are subject to change without notice.

  • Prices on our website exclude applicable taxes, shipping, handling, and customs charges.

  • You agree to provide current and accurate payment and account information.

  • Payment is authorized through your chosen method; all charges must be honored.

  • If you use Shop Pay, you agree that your information will be processed by Shopify according to their terms. SvetArts is not responsible for any loss, error, or issue resulting from the use of Shop Pay.

 

5. Shipping and Delivery

  • Delivery times are estimates and not guaranteed.

  • We are not responsible for delays caused by carriers, customs, or events outside our control.

  • Title and risk pass to you once the product is handed to the carrier.

     

6. Customer-Provided Items

  • For custom projects where the customer provides materials, items, or products to be altered, painted, or otherwise processed by SvetArts, the customer is solely responsible for ensuring the items are suitable for the intended purpose and legally owned.

  • SvetArts is not responsible for any loss, damage, or delays of customer-provided items during shipping to us or while in our possession.

  • In case customer-provided items are damaged, defective, or unusable upon arrival or during processing, SvetArts reserves the right to refuse completion of the project, and will not be liable for replacement, compensation, or reimbursement.

  • The customer is responsible for properly insuring the items during shipment to and from SvetArts if desired.

7. Client-Provided Intellectual Property

  • You are solely responsible for any designs, logos, characters, images, or other content (collectively, “Customer-Provided Content”) that you submit to SvetArts for use in custom products or services. By submitting such content, you represent and warrant that:

    • You are the owner of all rights in the Customer-Provided Content, or you have obtained all necessary permissions and licenses to use it;

    • The Customer-Provided Content does not infringe any third-party intellectual property rights, including trademarks, copyrights, or other proprietary rights;

    • The use of the Customer-Provided Content does not violate any applicable law.

  • Right to Refuse or Modify
    SvetArts reserves the right, at its sole discretion, to refuse to produce or deliver products that include Customer-Provided Content that appears to infringe third-party rights, is unlawful, or is otherwise inappropriate.

  • Indemnification
    You agree to indemnify, defend, and hold harmless SvetArts, its owners, employees, affiliates, and service providers from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to your Customer-Provided Content, including but not limited to claims of intellectual property infringement.

  • No Warranty or Liability
    SvetArts makes no representations or warranties regarding the legality or suitability of any Customer-Provided Content, and shall not be liable for any claims, damages, or costs arising from your submission, use, or display of Customer-Provided Content.

  • Any artwork shown on our website or social media featuring copyrighted characters, logos, or trademarks is displayed solely as private, non-commercial artwork or past commissioned work. Such designs are not offered for sale, and all rights belong to their respective trademark owners.

8. Intellectual Property of SvetArts

  • All content on the Services, including images, designs, logos, text, videos, and product layouts, is owned by SvetArts, its affiliates, or licensors.

  • You may use our Services for personal, non-commercial purposes only. Unauthorized copying, distribution, or modification is prohibited.

  • All rights not expressly granted are reserved.

9. Optional Third-Party Tools

  • We may provide access to optional tools or features from third parties. These are offered “as is” without endorsement or warranty.

  • Use of these tools is at your own risk and discretion.

10. Third-Party Links

  • Our Services may include links to third-party websites. We are not responsible for their content or policies.

  • Engagement with third-party sites is at your own risk.

11. Relationship with Shopify

  • Shopify powers the platform but all sales are directly with SvetArts.

  • Shopify is not responsible for any issues with orders, products, or transactions.

12. Refund & Return Policy

  • Custom projects, hand-painted, or unique products cannot be returned or exchanged, except if defective.

  • Refunds are only processed for defective items or errors made by SvetArts.

  • Please contact us promptly for any issues regarding your order.

13. Feedback

  • By submitting feedback, ideas, or suggestions, you grant SvetArts a perpetual, worldwide, royalty-free license to use them.

  • You represent that you have rights to the feedback and that it complies with these Terms.

14. Prohibited Uses

You may not use the Services to:

  • Violate laws, harass, or harm others.

  • Infringe third-party rights or intellectual property.

  • Upload viruses or malicious content.

  • Interfere with our systems or security.

15. Disclaimer of Warranties

  • SvetArts disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

16. Limitation of Liability

  • You agree to indemnify and hold harmless SvetArts, Shopify, and affiliates from claims arising from your use of the Services, breach of Terms, or violation of third-party rights.

18. Termination

  • We may terminate access to Services at any time for violation of these Terms.

  • Certain sections (Intellectual Property, Liability, Feedback, Privacy Policy) survive termination.
